Terms of Service

1) Scope

1.1 These terms and conditions apply to contracts for hotel rooms for accommodation as well as to all other services and deliveries provided to the guest by the hotel.

1.2 Subletting or subletting of the rooms provided is excluded.

1.3 General terms and conditions of the guest only apply if this has been expressly agreed in writing beforehand.


2) Conclusion of contract, partners, statute of limitations

2.1 The contract is concluded by accepting the guest’s offer. In this context, the Schlosshotel Brilon-Wald will send a booking confirmation.

2.2 All claims against the Schlosshotel Brilon-Wald become time-barred one year after the start of the limitation period, unless they are based on intent. Claims for damages independent of knowledge become time-barred after five years.

2.3 Persons under the age of 18 who wish to travel alone are not legally permitted to enter into an effective accommodation contract. This is only possible with the consent of a legal guardian. For legal reasons, we check your identity card or passport when you check in.


3) Services, prices, advance payments, offsetting

3.1 The Schlosshotel Brilon-Wald is obliged to have the rooms booked by the guest available and to provide the agreed services. The guest does not acquire the right to be provided specific rooms.

3.2 The guest is obliged to pay for the room provided and for other services used by him at the applicable or agreed price of the hotel. This also applies to services and expenses incurred by the guest for third parties.

3.3 The agreed prices include any statutory VAT.

3.4 The prices can be changed by the hotel if the guest subsequently makes changes

  • the number of booked rooms,
  • the performance of the hotel or
  • of the length of stay of the guests and the hotel agrees to these.

3.5 Hotel invoices are payable without deduction within 14 days of receipt of the invoice. In the event of late payment, the hotel is entitled to charge a lump sum (surcharge for late payment, processing fee) i. H. v. charge 25 euros.

3.6 The hotel is entitled to demand an advance payment or security deposit from the customer in the form of a credit card guarantee, a down payment or similar upon conclusion of the contract. The amount of the advance payment and its due date can be agreed in writing in the contract. The hotel is also entitled to issue an interim invoice to make any claims that have accrued during the guest’s stay at the hotel due at any time and to demand immediate payment.

3.7 In justified cases, e.g. B. If the customer is in arrears, the hotel is entitled to refuse further services.

3.8 The guest can only offset or reduce a claim from the hotel with an undisputed or legally binding claim.


4) Arrival and departure

4.1 The booked rooms will be made available from 3 p.m. on the day of arrival. Unless a later arrival time has been expressly agreed or the room has been paid for in advance, the hotel has the right to allocate booked rooms to someone else after 6 p.m. without the customer being able to derive a claim against the hotel from this.

4.2 On the day of departure, the rooms must be vacated by 12:00 p.m. In the event of late eviction, the Schlosshotel Brilon-Wald will charge a flat rate of 50% until 6:00 p.m., then 100% of the price up to the following day of eviction. The guest is permitted to prove that the damage was less. The extension of the tenancy according to §545 BGB is contradicted.

5) Withdrawal by the guest / non-use of hotel services

5.1 A rescission by the guest of the contract concluded with the Schlosshotel Brilon-Wald or a free right of rescission require the written consent of the hotel. If consent is refused, the agreed price must also be paid by the guest if the contractual services are not used and the Schlosshotel Brilon-Wald is willing and able to provide the contractual services.

5.2 The above regulations on compensation apply accordingly if the guest does not use the booked room or the booked services without notifying the hotel in good time.

5.3 The Schlosshotel Brilon-Wald is free to allocate the expenses saved as a result of non-use or cancellation and to demand the following fees from the guest for the contractually agreed prices:

best rate

  • until 6 p.m. on the day of arrival: can be canceled free of charge
  • after 6 p.m.: 90% of the total price

Early bird and last minute rate

  • From 60 days before arrival, 6 p.m.: 70% of the total price
  • From 21 days before arrival, 6 p.m.: 80% of the total price
  • From 7 days before arrival, 6 p.m.: 90% of the total price
  • From the day of arrival, 6:00 p.m.: 100% of the total price

The guest reserves the right to prove higher savings at the Schlosshotel Brilon-Wald.

5.4 Contractual or statutory rights of withdrawal remain unaffected.


6) Cancellation by the hotel

6.1 If a free right of withdrawal for the guest has been agreed, the Schlosshotel Brilon-Wald is also entitled to withdraw from the contract within the agreed period if there are inquiries from other guests about the booked rooms and the guest does not finally confirm the booking when asked.

6.2 If an agreed advance payment or security deposit is not made within a period set for this purpose, the hotel is also entitled to withdraw from the contract.

6.3 The extraordinary right of withdrawal remains unaffected by the above regulations.

6.4 The Schlosshotel Brilon-Wald reserves the right to cancel guest reservations within 48 hours.


7) Liability of the Hotel

7.1 Claims by the guest for damages are excluded. Excluded from this are damages resulting from culpable injury to life or health as well as other typical contractual obligations if the Schlosshotel Brilon-Wald or a legal representative or vicarious agent is responsible for the breach of duty, as well as other damages resulting from an intentional or grossly negligent breach of duty by the Schlosshotel Brilon -Walds or a legal representative or vicarious agent.

7.2 The hotel is liable to the guest for items brought in in accordance with the statutory provisions. For the rest, 7.1 applies accordingly.

7.3 Claims by the guest due to the loss, destruction or damage of items brought in must be reported to the Schlosshotel Brilon-Wald immediately.

7.4 Parking vehicles free of charge in the Schlosshotel Brilon-Wald car park does not constitute a custody agreement. Liability for lost or damaged vehicles parked or maneuvered on the premises of the Schlosshotel Brilon-Wald is excluded. For the rest, 7.1 applies accordingly.

7.5 Items left behind will only be forwarded at the customer’s request, risk and expense. The hotel keeps the items for three months. If there is no recognizable value, the hotel reserves the right to destroy them after the deadline.


8) Final Provisions

8.1 Changes or additions to the contract concluded between the Schlosshotel Brilon-Wald and the guest must be in writing; this also applies to an agreement excluding the written form.

8.2 The place of performance and jurisdiction is the seat of the Schlosshotel Brilon-Wald.

8.3 Should individual provisions of these terms and conditions be ineffective or void, this shall not affect the validity of the remaining provisions. Instead of the void or ineffective regulations, the statutory regulations are to be applied insofar as they come closest to the parties.
